Mykola Burtovyi runs the Litigation Department of “Nikitchenko & Partners” company and has almost ten years of experience in this sphere. Under his management the litigation team successfully provides legal services for clients in economic courts, administrative courts, arbitration courts and courts of general jurisdiction, including the higher judicial instances, such as, - Supreme Commercial court of Ukraine, High administrative court of Ukraine and the Supreme Court of Ukraine.

The litigation includes not only participation in trials, but also such important stages of client protection, as mediation and / or representation of clients’ interests in negotiations on pre-judicial settlement of disputes.

If a dispute does not see possible to solve without trial, associates of our company, first of all, analyze a legal position, and develop effective protection strategy of the client, collect proofs, and prepare all necessary legal documents in courts: claims, objections, petitions, statements, appeals and cassations.

We are experienced in the settlement of commercial disputes which arise from conclusion, change, breach and carrying out of contracts, including issues concerning privatization and property rent, disputes, on compensation of harm or losses, bankruptcy proceeding, and tax resolving disputes which are subjects of administrative legal proceeding.

Besides, we are engaged in protection of managing subjects against unfriendly acquisition (raid attack). As an example, it is possible to result an attempt of hostile takeover which has been carried out in 2006 - 2007 concerning a publishing leader in the Zaporozhye region - Open Joint Stock Company "Zaporizhknyga".

It had been developed an effective protection strategy by the “Nikitchenko & Partners” company of the client which was applied by senior lawyer Andrey Popov. Eventually, an attempt of hostile takeover of the enterprise has been stopped as a result of the spent preventive measures against hostile takeovers, and also effective opposition, in courts of different instances.
